Scanner Registration Requirement
Retail stores using scanners in San Diego County are
required by County ordinances to register with the San Diego
County Department of Agriculture, Weights and Measures.

On February 2, 1999, San Diego County enacted the
Consumer Confidence Protection Act of 1999. Chapter 20
(Division 1 of Title 2) of the San Diego County Code of
Regulatory Ordinances requires owners/users of Automated
Point-of-Sale Systems to obtain a permit annually from the
County Sealer.

In addition to the above requirements for retailers using
scanners, the ordinance also reads, "A Point-of-Sale System
includes, but is not limited to, equipment that uses Universal
Product Code scanners, price look-up codes, or any other
system that relies on retrieval of electronically stored
information to complete a transaction of commerce between
a retailer and a customer."

In speaking with a Deputy Sealer with the Department we
found out that this requirement includes cash registers and
POS systems that utilize PLU'S (Price Look Up's) to enter an
item being sold to a customer. As he explained, prepared
foods such as those found in a fast food or sit down
restaurant are considered to be a service and not a
commodity for their purposes. According to N.I.S.T.
Handbook 130, this "applies to all retail stores, including
food, hardware, general merchandise, drug, automotive
supply, convenience, and club or other stores."
